The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

As schools publicly modernize in response to societal changes, additional teaching and learning methods are developed, observed, and used since learners have different learning styles that make it easier for them to grasp and retain the material. During the COVID-19 pandemic, teachers require different media to keep the classroom involved while presenting the lesson materials online, one of which is video tutorials. The purpose of this study was to analyze the extent of contextual effects of video tutorials used in general (...) chemistry, determine the relationship between video tutorial effectiveness and the respondents' academic performance, and analyze the significant difference between the four indicators of contextual effects of video tutorials and the respondents' profile. A descriptive-correlational quantitative research design was used in this study. The participants in this study were 144 Grade 12 STEM students from a private school in Sultan Kudarat, Philippines, who took their general chemistry course during the pandemic. The respondents were given a survey questionnaire created with Google Forms. The students agreed with all the assertions and rated them as effective in terms of their perceptions of general chemistry, implying that video tutorials are useful in teaching the subject. With p-values of .023, .046, and .010, respectively, the findings revealed a significant relationship between the overall mean of students' perceptions of the subject of General Chemistry, the concept and application of chemical knowledge and understanding, and their influence on students' academic performance. In terms of their perception, ideas, and application of chemical knowledge and comprehension, the results demonstrated that there is no statistically significant difference between the general mean of male and female students' responses. This basically means that by using video lectures, STEM students of all genders appreciate and understand General Chemistry as a subject. -/- . (shrink)

Many theists conceive of God as a perfect being, i.e., as that than which none greater is metaphysically possible. On this grand view of God, it seems plausible to think that such a supreme and maximally great being would not be subject to luck of any sort. Given the divine perfections, God is completely insulated from luck. However, I argue that the opposite is true: precisely because God is perfect, he is subject to a kind of luck called constitutive luck. (...) In this paper, first I provide an analysis of luck and then explain the concept of constitutive luck. I proceed to defend constitutive luck from charges of incoherence and examine a different approach to make sense of this luck. Furthermore, I distinguish between two kinds of constitutive luck and argue that even if God isn’t subject to one kind, evading the second kind is unsuccessful. I offer two ways that God is constitutively lucky and reach a surprising conclusion: a perfect being is the luckiest of all possible beings. (shrink)

This paper continues a dialogue that began with an article by Jeffrey Koperski entitled “Two Bad Ways to Attack Intelligent Design and Two Good Ones,” published in the June 2008 issue of Zygon: Journal of Religion and Science. In a response article, Christopher Pynes argues that ad hominem arguments are sometimes legitimate, especially when critiquing Intelligent Design (2012). We show that Pynes’s examples only apply to matters of testimony, not the kinds of arguments found in the best defenses of ID.

In this work we present the function and we determine the nature of conventions and hypotheses for the scientific foundations according with the conventionalist doctrine that arose in France during the turning of the XIX century to the XX. The doctrine was composed by Henri Poincaré, Pierre Duhem and Édouard Le Roy. Moreover, we analyze the relation that conventions and hypotheses can establish with metaphysical thesis through criteria used by scientists in order to determine the preference for certain theories. Thereunto, (...) we promote an immanent interpretation of published works between 1891 and 1905. As result, we reveal that the authors, though being classified as belonging to the same doctrine, don't have only common grounds, but also divergences. Poincaré and Le Roy agree that geometrical conventions are chosen in accordance with convenience criteria. However, they disagree about the value convenience aggregate to scientific knowledge. In regards to natural phenomena, the three authors agree that reality can't be described univocally by the same set of conventions and hypotheses. Yet, Poincaré and Duhem both believe that there are experimental, rational and axiological criteria that justify scientist's satisfaction with certain theories and we indicate how those criteria are related with metaphysics. We conclude that conventionalists, even if warily and implicitly, searched to approach metaphysics in order to justify scientific activity. (shrink)

It has been argued that moral assertions involve the possession, on the part of the speaker, of appropriate non-cognitive attitudes. Thus, uttering ‘murder is wrong’ invites an inference that the speaker disapproves of murder. In this paper, we present the result of 4 empirical studies concerning this phenomenon. We assess the acceptability of constructions in which that inference is explicitly canceled, such as ‘murder is wrong but I don’t disapprove of it’; and we compare them to similar constructions involving ‘think’ (...) instead of ‘disapprove’—that is, Moore paradoxes (‘murder is wrong but I don’t think that it is wrong’). Our results indicate that the former type of constructions are largely infelicitous, although not as infelicitous as their Moorean counterparts. (shrink)

Feita de um ponto de vista sobretudo pessoal, esta homenagem não poderia deixar de mencionar algumas das virtudes que se sobressaem em seu trabalho e que no meu entendimento conferem exemplaridade às suas contribuições para os estudos Nietzsche no Brasil. Entre essas virtudes destaco por fim a gentileza, que curiosamente não costuma figurar no catálogo das virtudes intelectuais. O trabalho de André Itaparica é (...) um convite para que essa negligência seja revista.: This paper pays tribute to André Itaparica’s career in the Brazilian Nietzsche research. Written mostly from a personal point of view, this homage couldn’t fail to mention the many virtues embodied by his scholarly work, which in my view place it in an outstanding position in the Brazilian Nietzsche studies. Over the last thirty years, once staunchly historical cinema scholars such as Thomas Elsaesser, Jane Gaines, Siegfried Zielinski, and André Gaudreault have abandoned history for historiography and film studies for media archaeology. With increasing attention on the “database” as a symbolic metaphor for postmodernity and the decentered, networked tenants of the global present, cinema is taking on the characteristics of new media, existing in intertextual space. Thus, the term “post-cinema” has been co-opted as a viable intermediary that accounts for (...) new media conditions, as cinema is no longer emblematic of our cultural climate. As Giorgio Agamben wrote in 1992, “[t]he end of the cinema truly sounds the death knell of the ultimate metaphysical adventure of Dasein. In the twilight of post-cinema…human quasi-existence, now stripped of any metaphysical hypostasis and deprived of any theological model, will have to seek its proper generic consistency elsewhere." Accordingly, we are no longer “moviegoing animals” who seek images of ourselves among a collective in the dark but, rather, users interfacing within a network of moving images. (shrink)

Matagal nang dinalumat ang konsepto ng Inang Bayan bilang kabuuang tunguhin ng kilusang panghimagsikan ng Kataastaasan, Kagalang-galangang Katipunan (KKK) ng mga Anak ng Bayan. Lehitimong gawain ito dahil bukod sa kontekstong nakaugat ang bayan sa ina/mater vis-à-vis patria, mahihinuha ring malaki ang pagkilala ng Supremong si Andres Bonifacio sa kadakilaan ng kababaihan sa panahon ng himagsikan. Sa kabila nito, masasabing may suliranin sa historiograpiyang Pilipino dahil isinasantabi ng ilang positibista at sexistang manunulat ang kolektibong gunita sa kababaihan bilang kasama ng (...) bayan. Kung kaya’t patuloy itong iwinawasto sa pagdaan ng panahon. Masusumpungan ito kung gagawing halimbawa ang kababaihan sa rebolusyong Pilipino. Naisasantabi sila bilang mga paksa ng pag-aaral o kung minsan, itinuturing na palamuti lamang na kailangang idugtong sa pangalan ng kalalakihan. Kaugnay ng suliraning ito kung kaya’t itinatampok sa pag-aaral na ito ang muling pagsipat sa apat na mahahalagang bagay: (1) kasaysayan ng kababaihang Pilipina noong dantaon 19; (2) pakikisangkot ng kababaihan sa Katipunan at himagsikan; (3) pagtingin ng Katipunan sa kababaihan; at (4) impluwensya ng Katipunan sa pagkilos ng kababaihan sa pagpasok ng dantaon 20. Thus, the (...) term “post-cinema” has been co-opted as a viable intermediary that accounts for new media conditions, as cinema is no longer emblematic of our cultural climate. It was once presaged in 1992 that “[t]he end of the cinema truly sounds the death knell of the ultimate metaphysical adventure of Dasein. In the twilight of post-cinema, of which we are seeing the beginning, human quasi-existence, now stripped of any metaphysical hypostasis and deprived of any theological model, will have to seek its proper generic consistency elsewhere.” Accordingly, we are no longer “moviegoing animals” who seek images of ourselves among a collective in the dark but, rather, users interfacing within a network of moving images. By locating post-cinema within the semblance of social media, we are allocated a newfound series of theoretical interventions, the most marked of which is that of media archeology vis-à-vis dialectical materialism. This is a lens through which Brian Winston has recently deftly decried Virtual Reality’s “empathy machine” utopic illusionism, bolstered by Chris Milk and a slew of neurohumanities researchers, steadily maintaining that the fundamental myth of “technologies of seeing” is in disguising “their artifice, their cultural formation and their ideological import.” However, this approach, which illuminates the bifurcation between Max Horkheimer/Theodor Adorno and Walter Benjamin, neglects what Benjamin identified as occurring to the work of art in the age of its technological reproducibility—a shift from a technology’s “cult value,” associated with the unique work, to its “exhibition value,” associated with the social act of viewing as part of a mass. Speaking to this divarication, Benjamin Barber, in Strong Democracy, foresaw new media’s two-fold potential—as they are organized and networked, new media and communications technologies possess the possibility to both energize citizen information and political participation but, simultaneously, to supplement the deterioration of public debate. As evinced by Mark Adrejevic’s concept of Infoglut, this two-pronged possibility has only been exacerbated by the interlocking relationship between the advent of a “glut” of information, post-truth politics, the demise of symbolic efficiency, and a renewed focus on the role of affect and emotion as “alternative modalities for thinking about the role of communication in a post-referential era.” Manuel Castells qualifies Barber’s pessimism, noting that the Internet can “be an appropriate platform for informed, interactive politics, stimulating political participation.. […] beyond the closed doors of political institutions,” but that the Internet, like any technology, “is shaped by its uses and users.” Thus, if there exists a positive correlation between exposure to post-cinema media artifacts and political participation, then I seek to explore the revelatory political possibilities of “exhibition value” by way of a particular “post-cinema” case study: the Marxist-Leninist Turkish hacktivist group Redhack’s YouTube-circulated documentary RED! NUTRIÇÃO SOBRE AS FALHAS REPRODUTIVAS DOS BOVINOS -/- E. I. C. da Silva Departamento de Agropecuária – IFPE Campus Belo Jardim Departamento de Zootecnia – UFRPE sede -/- -/- FALHAS REPRODUTIVAS DE BOVINOS -/- INTRODUÇÃO -/- Os bovinos, assim como tantos outros mamíferos e demais espécies, podem sofrer distúrbios durante o ciclo reprodutivo. Transtornos, alterações ou patogenias afetam diretamente a saúde do sistema reprodutor desses animais. As causas podem ser individuais ou multifatoriais, de caráter parasitário, patogênico, climático, nutricional etc. As (...) causas de caráter parasitário podem ser controladas mediante a assepsia e profilaxia para a eliminação dos parasitas como carrapatos que vivem no mesmo habitat que o animal. As de caráter patogênico, como estão relacionadas à doenças, necessitam de especialistas na área, como o médico-veterinário para a avaliação, diagnóstico e tratamento por meio de práticas cirúrgicas ou na administração de fármacos. O fator clima pode ser controlado mediante o investimento em tecnologia e aquisição de equipamentos que possam manter a integridade e o bem-estar do animal, seja por ventiladores, exaustores, nebulizadores, aspersores, etc. Por fim, as de caráter nutricional podem ser prevenidas mediante a boa administração energética, proteica e mineral, além de uma boa qualidade de alimento volumoso ou concentrado que atenda e supra os requerimentos exigidos por cada categoria animal. Sendo assim, pode-se dividir as falhas reprodutivas dos machos bovinos relacionados à nutrição em energia, proteína, minerais e vitaminas. Antes disso, essas falhas estão relacionadas aos fatores de degeneração testicular e casos de hipospermia. -/- 17.1 Degeneração testicular e Hipospermia -/- Degeneração testicular é uma importante causa de infertilidade em machos de todas as espécies. Entre as causas, podem ser consideradas a elevação da temperatura testicular (por isso torna-se importante que a bolsa escrotal tenha um certo tamanho que permita aos testículos ficarem longe do corpo, uma vez que a temperatura corporal mataria os espermatozoides, sendo essencial os testículos ficarem “caídos” para que possam ter no mínimo 2-3 °C à mesmos do que a temperatura corporal), infecções, fatores nutricionais, lesões vasculares, lesões obstrutivas etc. O testículo com degeneração mostra diminuição de tamanho, fibrose, alterações na espermatogênese, aumento de esperma imaturo ou anormal e azoospermia em casos severos. -/- Em casos de lesão testicular com dano parcial sobre o epitélio germinal, apresenta-se uma menor taxa de formação e maturação das células espermáticas. O macho pode ser fértil, mas a condição de hipospermia levará à que, sob condições de estresse ou alta carga de fêmeas a cobrir, se apresentem falhas na fertilização. Ejaculados com características de hipospermia não podem ser congelados, logo não servem para a indústria do sêmen. -/- -/- Deficiências nutricionais retardam o início da puberdade e deprimem a produção e as características do sêmen. Os efeitos da má nutrição podem ser corrigidos em animais maduros, enquanto que é menos bem sucedido em animais jovens devido aos danos permanentes causados no epitélio germinal do testículo. (FRAZER, 2005; GORDON, 1996). Entre as principais limitantes de origem nutricional temos: -/- 17.2 Vitaminas -/- 17.2.1 Vitamina A -/- A deficiência de vitamina A e provitamina A (já que é essencial direta ou indiretamente para a função de todos os órgãos e particularmente para o crescimento e desenvolvimento dos epitélios) é necessária para a diferenciação celular, processo no qual se modificam as células não especializadas de modo que possam realizar funções específicas. Os órgãos reprodutores exigem retinol para que possam realizar o processo de espermatogênese normal nos machos e para prevenir a necrose placentária e a mortalidade fetal na fêmea. Carências de Vitamina A produzem: degeneração do epitélio germinal, baixa espermiogênese parcial ou total, cornificação do epitélio vaginal, irregularidades do estro, atrasos na concepção, abortos, crias fracas e/ou deficientes visuais (cegas) e uma degeneração da placenta e a retenção da mesma. A deficiência da vitamina A pode conduzir a uma degeneração dos tubos seminíferos nos bovinos jovens e deve-se ao fato da supressão da liberação de gonadotropinas hipofisárias e noutros casos, a espermatogênese é impedida e as funções das células de Sertoli e de Leydig são alteradas. A vitamina A não é sintetizada no organismo, o que leva a uma dependência direta do fornecimento dessa vitamina através dos alimentos que o criador têm na propriedade, seja forragens ou concentrados de ótima qualidade. -/- Essa vitamina é essencial para os animais e humanos, visto que participa de inúmeras funções metabólicas no corpo dos mesmos. Sendo assim, o criador deve saber das exigências vitamínicas do seu rebanho. Em bovinos de corte a exigência e a recomendação de fornecimento dessa vitamina está entre 2200 UI/kg de MS para animais em crescimento e engorda e para reprodutores recomenda-se níveis de 3900 UI/kg de MS. Já para bovinos leiteiros esses números são diferentes, de acordo com livros de nutrição de ruminantes, animais em crescimento e engorda devem consumir matéria seca com teores de 80 UI/kg de MS, já para reprodutores e animais adultos a quantidade recomendada e exigida é de 110 UI/kg de MS, isso diariamente. As forragens suprem bem a exigência de vitamina A dos animais, em especial o capim tifton e o tanzânia são os mais recomendados uma vez que possuem altos teores vitamínicos e minerais. As vias de suplementação dessa vitamina é através das forragens (mais acessível e barato), através da ração concentrada ou pela água e suplementação injetável. -/- 17.2.2 Vitamina E -/- A vitamina E é uma substância também conhecida como tocoferol, sendo sua forma mais ativa o alfa tocoferol. A vitamina E pertence ao grupo de vitaminas lipossolúveis amplamente distribuídas nos alimentos. -/- A sua principal função é descrita como um antioxidante natural, agindo como tal, a vitamina E evita a oxidação de constituintes celulares essenciais e/ou evita a formação de produtos tóxicos de oxidação, como os produtos de peroxidação formados a partir de ácidos graxos insaturados que foram detectados através de sua ausência. Essa vitamina é essencial para a reprodução normal em várias espécies de mamíferos. Ela ainda têm sido usada em clínicas reprodutivas de todo o mundo para o tratamento de abortos recorrentes e da infertilidade em ambos os sexos (CHAN, 2003). -/- -/- A deficiência da vitamina E influencia a maturação espermática e a degeneração do epitélio germinal dos túbulos seminíferos, já que ela os protege da oxidação evitando a deterioração da peroxidase sobre os fosfolipídios poli-insaturados da membrana espermática (PITA RODRÍGUEZ, 1997). A deficiência dessa também evita o crescimento anormal. Na ausência de vitamina E, a quantidade de gorduras insaturadas dentro das células diminuem, causando anomalias estruturais e funcionais das organelas mitocondriais, lisossomos e até mesmo na membrana celular, se essa falta de vitamina E no adulto tornar-se acentuada ocorrerá a degeneração precoce do epitélio germinal, o que afeta, em primeiro lugar, as células mais evoluídas: os espermatozoides, cuja mobilidade se perde e sua formação torne-se cada vez mais rara, até chegar ao nível de esterilidade completa. -/- As exigências dos bovinos de corte quanto a vitamina em questão é de 15 – 60 UI/kg de MS diárias para animais em crescimento e engorda. Já para bovinos leiteiros, essa exigência é muito menor chegando a 0,8 UI/kg de peso vivo (PV) para animais em crescimento e engorda e para animais adultos e reprodutores cerca de 1,6 UI/kg de PV diários. Os alimentos, assim como as vias de suplementação ideais, são os mesmos mencionados no tópico acerca da vitamina A. -/- 17.3 Proteínas -/- O efeito do excesso de proteína da dieta na reprodução é complexo. Os excessos de proteína podem também ter um efeito negativo na reprodução. Alguns efeitos foram demonstrados para explicar o pobre desempenho reprodutivo que algumas vezes é observado em dietas com excessivos níveis de proteína: Podem apresentar-se altos níveis de ureia no sangue, o que possui efeito tóxico sobre os espermatozoides, óvulos, e o embrião em desenvolvimento (WATTIAUX, 1990), igualmente, apresenta-se um desequilíbrio energético que em casos severos bloqueia a liberação de LH produzindo alteração na maturação espermática nas células de Leyding. -/- As proteínas são importantes para todo o funcionamento normal e funções fisiológicas e metabólicas dos animais e do homem. Logo, a tabela 1 traz os níveis recomendados e exigências de bovinos de corte de diferentes categorias para que se possa prevenir e/ou combater as possíveis degenerações testiculares bem como a hipospermia, trazendo os requerimentos de bovinos leiteiros jovens o que é mais ideal para combater previamente esses distúrbios que afetam diretamente a função reprodutiva e o desemprenho dos animais. -/- Tabela 1: Exigências de proteína metabolizável (PM) e proteína bruta (PB), para diferentes categorias de bovinos de corte -/- BAIXE O PDF E VISUALIZE A TABELA -/- Para os bovinos leiteiros jovens, os níveis de PB presente na dieta dos animais entre 150 e 400 kg de PV podem ser entre 12 e 22%, o que é ideal para a prevenção de degenerações, atraso à puberdade ou qualquer anormalidade que afete o desempenho dos animais. -/- Os alimentos mais proteicos são os de origem animal, porém não se pode ofertá-los completamente e diretamente aos animais, isto é, deve-se misturá-los a outros ingredientes; logo, o tipo e a quantidade de proteína depende dos ingredientes, do método de alimentação e do potencial produtivo e genético dos animais. -/- 17.4 Minerais -/- 17.4.1 Manganês (Mn) -/- O manganês é um componente de várias enzimas e essencial para a estrutura óssea normal. Quando a alimentação é deficiente em Mn por algumas semanas, o corpo parece conservar este mineral de forma eficaz. -/- Numa dieta média, cerca de 45% do mineral ingerido é absorvido. A absorção pode ser diminuída com o consumo de quantidades excessivas de Ca, P ou Fe. Após a absorção, o Mn liga-se à sua proteína transportadora e é conhecido como transmanganina. Os ossos, e em menor quantidade o fígado, músculos, e pele servem como locais de armazenamento desse mineral. -/- O Mn está envolvido na função pancreática e na utilização correta da glicose, sendo também um interveniente ativo na produção de tiroxina e de hormonas sexuais. Tem importância na produção do colesterol e no metabolismo de gorduras. -/- O Mn é um mineral de grande afinidade com o aparelho reprodutor. A deficiência desse elemento produz uma diminuição da fertilidade, atraso no desenvolvimento testicular e diminuição da espermatogênese. Se houver atrofia dos testículos, a produção de espermatozoides será reduzida e, portanto, a fertilidade será afetada. -/- A quantidade de 13 mg de Mn por kg de MS é suficiente para a obtenção de um crescimento adequado, mas para um crescimento testicular ideal e constante é necessário um mínimo de 16 mg de Mn por kg de MS. -/- Para uma boa suplementação que atenda às necessidades do gado de corte e leite, o nível ideal de Mn presente na MS em mg/kg deve estar entre 12 – 18 para os bovinos leiteiros e entre 20 – 50 para o gado de corte, tendo como recomendação ideal cerca de 40 mg/kg de MS diários para ambos. Esse mineral pode estar presente tanto na água quanto nas plantas presentes no pasto, portanto a suplementação natural é a melhor escolha, caso necessário a suplementação artificial através da ração no cocho ou do sistema SMI é recomendada. -/- 17.4.2 Iodo (I) -/- A deficiência de I também ocasionar dificuldades reprodutivas e hipospermia. Só a captação da tiroide responde à TSH, e somente a glândula endócrina tiroide incorpora esse elemento nos hormônios que são por ela elaborados. Assim, mais de 90% do iodo do organismo é encontrado nas glândulas tireóideas, principalmente como iodo orgânico. Este grande acúmulo de I na glândula é trocado muito lentamente, cerca de 1% por dia. -/- O I entra no organismo via oral e sob a forma de íon iodeto, absorvendo-se muito facilmente desde o aparelho digestivo e passando rapidamente à corrente circulatória e, posteriormente à glândula tiroide (ALBARRACÍN, 2005) onde tem que vencer um gradiente de concentração de 1 a 20; todavia, dada a afinidade entre essa glândula e o iodo, não existe nenhum problema na organização. Na célula folicular, através da ação da peroxidase, converte-se em I molecular que passa para o coloide para se ligar à tiroglobulina e formar as hormonas tireóideas. -/- O I pode atuar sobre o aparelho genital diretamente ou através da hipófise. A tiroidectomia reduz a produção espermática, por sua vez a tiroxina exótica pode restaurá-la. Essa última, administrada dentro de seus limites fisiológicos, aumenta a produção espermática ao incrementar o metabolismo geral. Talvez, o mecanismo mais aceito para atingir esta função fisiológica seja a regulação do consumo de oxigênio pelas células espermáticas. -/- O I pode ser fornecido em quantidades entre 0,2 e 1,0 mg/kg de MS para todas as categorias animais e sem que o produtor possa se preocupar. O I, que é de suma importância, encontra-se na água e nos vegetais, porém pode ser incrementado via alimentação concentrada ou através da injeção mineral direta no animal. -/- 17.5 Energia -/- A disponibilidade de energia está diretamente relacionada com o padrão normal de pulsatilidade do LH. No caso do balanço energético negativo (BEN), verifica-se um rápido aumento da utilização de glicose, resultando em hipoglicemia e, por conseguinte, hipoinsulinemia que, como se sabe, conduz rapidamente a uma lipólise com maior disponibilidade de ácidos para oxidação. Por sua vez, a síntese de colesterol precursor de esteroides sexuais é diminuída. A alteração da relação estrogênios- androgênios no macho causa uma expressão pobre da libido ou desejo sexual. -/- No touro a subnutrição afeta intensamente a função secretora das glândulas acessórias, provocando uma diminuição de 30 a 60% nas concentrações de frutose e ácido láctico do esperma. RESUMO O presente trabalho mostra as atividades realizadas do período de 01 de julho a 01 de novembro na JRM Agropecuária. As atividades foram desenvolvidas na área de bovinocultura de leite, este trabalho foi desenvolvido sob orientação do professor mestre Rodrigo Dorneles Tortorella e supervisão do médico veterinário André Ricardo, em conjunto com o médico veterinário Breno. Durante o período de estágio foi acompanhado as atividades realizadas no setor de manejo, reprodução, bezerreiro e recria da fazenda, além de acompanhar (...) as consultorias quinzenais realizadas pelos médicos veterinários. Este trabalho é composto pela descrição de estágio, referencial bibliográfico e relato de caso. O manejo reprodutivo pode trazer muito impactos econômicos se não for realizado de forma adequado, para trazer melhores resultados biotécnicas da reprodução foram criadas, como por exemplo a inseminação artificial, juntamente com ela, protocolos de inseminação são usados, para isso é necessário conhecer a anatomia do animal e a fisiologia do ciclo estral, trazendo então melhores resultados adequando a necessidade da propriedade. O relato de caso consiste na avaliação da taxa de concepção ao primeiro serviço de vacas leiteiras primíparas e multíparas no pós-parto em anestro, submetidas a uma pré-sincronização anterior a um protocolo de IATF, o qual obteve resultado e a maioria dos animais responderam a pré-sincronização, e as taxas de concepção foram superiores comparadas apenas a utilização de IATF, obtendo 37% de animais gestantes ao primeiro serviço. The field of textbooks in philosophy of mind is a crowded one. I shall consider six recent texts for their pedagogical usefulness. All have been published within the last five years, though two are new editions of previously published books. The first three are authored monographs: by K. T. Maslin, Barbara Montero, and André Kukla and Joel Walmsley. I then review three anthologies, each with two editors: William Lycan and Jesse Prinz, Brie Gertler and Lawrence Shapiro, and Brian McLaughlin (...) and Jonathan Cohen. These six texts constitute a diverse bunch. Within each of the two groups (monographs and anthologies), each individual text differs significantly from the other two in its approach, scope, and thus suitability for various levels of teaching. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. According to Molinism, logically prior to his creative decree, God knows via middle knowledge the truth value of the counterfactuals or conditionals of creaturely freedom (CFs) and thus what any possible person would do in any given circumstance. Critics of Molinism have pointed out that the Molinist God gets lucky that the CFs allow him to actualize either a world of his liking or even a good-enough world at all. In this paper, I advance and strengthen the popular critique in (...) two ways. First, I specify the kind of luck to which God is subject, which is circumstantial moral luck. Second, and more importantly, I argue that exposure to this luck is problematic because something external to God and beyond his control determines the degree of praiseworthiness he deserves in relevant possible worlds. My main contention is that divine subjection to circumstantial moral luck raises the theoretical costs of Molinism. (shrink)

These thirteen paragraphs portray epistemology as the study, not directly of knowing as a human action (which could be considered the object also of anthropology) but as the study of the mode of being of the object in the subject and, in this sense, of intentional being. Moreover, intentional being is not understood as the being of the cognitional species or representation, which is real and subjective, but as the being of the known, as the presence of the known to (...) the knower (obviously, through the species but a being not reduced to the subjective being of the species): this kind of being is the proper object of epistemology. Other considerations regarding the distinction between metaphysics and epistemology take place as well. As regards the method, this essay attempts to apply Aquinas’ four steps of scientific reasoning to epistemology, in the following fashion and order: 1- Solution of the problem of the universals by recourse to the theory of the agent intellect (resolutio secundum rem); 2- Definition of knowledge as intentional possession of being (res. sec. rationem); 3- Judgment of value regarding the different instances of human knowledge or critique of knowledge (compositio secundum rem) and 4- Reinterpretation (in the light of the previous path) of common notions of epistemology, such as truth, certainty, evidence, and error (comp. sec. rationem). Given the importance of the principle of causality for the demonstration of God’s existence, this paper attempts to justify the evidence and necessity of the principle of causality, by following Fr. Fabro’s Thomistic defense—based on the notion of participation—but adding a particular emphasis on the notion of “being which is not per se,” this latter as an explanatory notion of the notion of “being which is by participation.” The introductory remarks touch upon two misunderstandings regarding the notion of participation employed (...) as a subject of the principle of causality: the first, considering “participated being” as a synonym of “received being,” and the second, the confusion, regarding the notion of being by participation, between its notional dependence on the notion of being as a whole and its real dependence on the real intensive Being. Then, in the first point, the defense of the principle of causality is distinguished from other related problems, like the particular applications of this principle. In the second and main point, we try to justify the necessity of being caused in the being which is experienced as being by participation, as follows: 1) that which is something by participation is not this something per se; 2) now, that which is not per se, either is not or is per aliud, 3) Therefore, that which is something by participation is per aliud. In the third and last point, we endeavor to justify the Thomism of our defense and of our emphasis on this notion of “being which is not per se” by considering two texts of St. Thomas. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

In a recent paper, Erasmus et al. (2021) defend the idea that the ambiguity of the term “explanation” in explainable AI (XAI) can be solved by adopting any of four different extant accounts of explanation in the philosophy of science: the Deductive Nomological, Inductive Statistical, Causal Mechanical, and New Mechanist models. In this chapter, I show that the authors’ claim that these accounts can be applied to deep neural networks as they would to any natural phenomenon is mistaken. I also (...) provide a more general argument as to why the notion of explainability as it is currently used in the XAI literature bears little resemblance to the traditional concept of scientific explanation. It would be more fruitful to use the label “understandable AI” to avoid the confusion that surrounds the goal and purposes of XAI. In the second half of the chapter, I argue for a pragmatic conception of understanding that is better suited to play the central role attributed to explanation in XAI. Following De Regt (2017) and Kuorikoski and Ylikoski (2015), the conditions of satisfaction for understanding an ML system are fleshed out in terms of an agent’s success in using the system. : New genetic technologies continue to emerge that allow us to control the genetic endowment of future children. Increasingly the claim is made that it is morally "irresponsible" for parents to fail to use such technologies when they know their possible children are at risk for a serious genetic disorder. We believe such charges are often unwarranted. Our goal in this article is to offer a careful conceptual analysis of the language of irresponsibility in an effort to encourage more care (...) in its use. Two of our more important sub-claims are: A fair judgment of genetic irresponsibility necessarily requires a thick background description of the specific reproductive choice; and there is no necessary connection between an act's being morally wrong and its being irresponsible. Why I thought it useful to offer an explanation of Hegel’s doctrine on the Incarnation was so that the reader may be empowered to identify Hegel’s influence in modern accounts of this mystery. In truth, what matters is not the theologian’s self-identification as Hegelian or as non-Hegelian, but whether or (...) not the theologian adopts Hegel’s concepts. This paper offers an explanation of the internal dynamism of Hegelian concepts and their relation to Christian doctrine in Hegel’s Phenomenology of Spirit. This research may help to show in what way it is possible to explain Christian religious doctrine with a philosophy other than the Thomistic one and how, at least in Hegel’s case, religious doctrine is changed and reduced to an erroneous philosophical content. Also, an attempt is made to show the internal “coherence” of this Hegelian re-reading of Christianity so that theologians may become more cautious about accepting an explanation of Christian doctrine simply because the Christian language is preserved in that explanation. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Abstract In The Descent of Man (1879), Charles Darwin proposed a speculative evolutionary explanation of extended benevolence—a human sympathetic capacity that extends to all nations, races, and even to all sentient beings. This essay draws on twenty-first century social science to show that Darwin’s explanation is correct in its broad outlines. Extended benevolence is manifested in institutions such as legal human rights and democracy, in behaviors such as social movements for human rights and the protection of nonhuman animals, and in (...) normative attitudes such as emancipative values and a commitment to promote the rights or welfare of animals. These phenomena can be substantially explained by cultural evolutionary forces that trace back to three components of what Darwin called the human “moral sense”: (1) sympathy, (2) our disposition to follow community rules or norms, and (3) our capacity to make normative judgments. Extended benevolence likely emerged with “workarounds,” including political ideologies, that established an inclusive sympathetic concern for sentient life. It likely became as widespread as it is now due to recently arisen socio-economic conditions that have created more opportunities for people to have contact with and take the perspective of a broader cross-section of humanity, as well as other species. Our purpose is to defend the possibility of “perceptualism,” that is to say, the position maintaining that the intelligible content of consciousness is given in perception and not posited by the activity of the subject. Assisted by the insights of Cornelio Fabro, this defense contrasts perceptualism with Bernard Lonergan’s “critical realism”. Exposed in 1948, within his masterpiece on the scope and limits of human knowledge, the epistemological tenets that Bertrand Russell regarded as fundamental elements in the construction of scientific knowledge, are still worthy of a detailed discussion today. Given the excellence of the author, it will not be surprising to see that Russell's gnoseologic postulates, even for the present scientific view, address some of the most controversial questions still to be solved in the theory of knowledge.

The purpose of this paper is to give the main lines of a theological accounting for the fullness of knowledge in Christ from the time of his conception. We follow the doctrine of St. Thomas and take into account some objections which are relatively modern. The paper is intended as a systematic articulation that is faithful to the Tradition and the doctrine of the Church and also concerned with faithfully interpreting the whole biblical narrative in our preaching. In particular, we (...) have in mind Gilles Mongeau’s question: “If from the beginning [Jesus] has all knowledge, how could he learn, which is such a fundamental part of a genuinely human existence?” We try to connect the issue of the knowledge of Christ with the reasons for the Incarnation. First, we show that our theological accounting finds support in the Magisterium and in the Bible. Secondly, we try to articulate systematically the reasons for affirming the fullness of human knowledge in Christ and the progression in his acquired knowledge. (shrink)

Cada día es más evidente que existen muchas formas sutiles de exclusión y parcialidad que afectan el correcto funcionamiento de los sistemas jurídicos. El concepto de injusticia epistémica, introducido por la filósofa Miranda Fricker, ofrece una herramienta conceptual útil para comprender estas formas de exclusión y parcialidad judicial que a menudo pasan desapercibidas. En este artículo presentamos la teoría original de Fricker y algunas de las aplicaciones del concepto de injusticia epistémica en los procesos jurídicos. En particular, queremos demostrar que (...) la semilla sembrada por Fricker ha generado un floreciente campo de estudio en el cual el concepto se utiliza para analizar muchos fenómenos diferentes en el ámbito jurídico, no siempre siguiendo la caracterización original proporcionada por ella. Esto ha llevado a una distinción entre lo que llamaremos la versión estrecha del concepto, que se acerca a la descripción original de Fricker, y la versión más amplia de injusticia epistémica, que es una noción más controvertida porque existe el riesgo de que se confunda con otros conceptos más conocidos como el sexismo, la discriminación racial, la opresión, el silenciamiento y el gaslighting. Mostraremos que el valor de la versión estrecha es principalmente teórico y que para utilizar el concepto de injusticia epistémica se debe adoptar una comprensión más liberal del mismo. (shrink)

Natural selection is one of the fundamental keys of evolutionary biology, which is as much as saying of almost all life sciences. However, the effort to assess its true meaning has been involved in endless controversies almost from the beginning. The rethinking of natural selection through an abstract scheme with three ingredients - −population, environment and interaction between them− could significantly contribute to clarify this debate.

Mixing methods is a well-known innovative meth- odologic proposal for research in the second half of the 20th century social sciences. Reading literature about it, I observed the aspect that justifies this paper: Authors of theoretical contributions on mixing methods recognized that this was known to be a practice already in use many centuries ago. Some of them even have re-examined the whole history of the scientific method to search precedents. They are however individual and theoretical precedents. I add in (...) this paper the practical projection of these and other methodological theories on people’s training from Greek classical times. My hypothesis is that liberal arts was the basic syllabus in Western -and westernized- educaion for more than a millennium in such a way that results of their training precisely involved to mixing methods. In return, to understand the liberal arts in the light of mixing methods shows new aspects of their historical interest. I study the theoretical basis of this syllabus from Cicero to Alcuin. More important for future research, I conclude that Alcuin’s thesis about the correspondence between the gifts of the Holy Spiritu and the seven liberal arts can be extended to the Aristotelian dianoethics habits and to Dilthey’s 20th-century sciences of mind. Aunque el derecho probatorio y el derecho procesal se han dedicado desde siempre al estudio de los problemas relacionados con las pruebas y el establecimiento de los hechos en los procesos judiciales, el énfasis ha estado siempre en el aspecto formal, doctrinal y procedimental en detrimento de los fundamentos filosóficos y teóricos. Durante los últimos años ha habido un intento sostenido de explorar estos fundamentos combinando no sólo las herramientas tradicionales proporcionadas por la lógica, la gramática y la retórica, sino (...) también los avances hechos en ciencias como la estadística y la probabilidad, la medicina y la psicología forenses, la psicología de la percepción, la epistemología y la filosofía de la ciencia. El presente libro reúne las contribuciones de destacados juristas y filósofos latinoamericanos a esta nueva perspectiva interdisciplinaria, conocida como epistemología jurídica. El libro está dividido en tres grandes temas: la primera parte explora los problemas epistemológicos del conocimiento de los hechos en los procesos judiciales; la segunda se enfoca en el problema de los estándares de prueba; y la sección final discute el testimonio de los expertos. St. Thomas Aquinas has always considered intelligence a potency higher than the will, absolutely speaking. That being said, and in my view, the existential primacy of the will in the act of freedom (particularly in choosing the existential end) is also indisputably Thomistic, as Cornelio Fabro has shown. This paper endeavors to explain Aquinas' doctrine on the absolute primacy of the intellect and thus show that these two primacies can be affirmed coherently, that is, the intellect’s absolute primacy and the (...) will’s existential primacy. Firstly, I will explain the reasoning St. Thomas Aquinas uses in the Summa to justify the absolute primacy of the intellect over the will. Secondly, I will explore some parallel texts, in order to shed light on my interpretation of the Summa and expand our view regarding this and related doctrinal points. Thirdly, I will offer a brief study of Fabro’s position, one in which his concerns regarding the intellect’s absolute primacy are taken into account and carefully considered. (shrink)

Proponents of the duty to vote (DTV) argue that in normal circumstances, citizens have the moral duty to vote in political elections. Discussions about DTV analyze _what_ the duty is, _who_ has this duty, _when_ they have it, and _why_ they have it. Missing are answers to the Specification Question: to _which_ elections does DTV apply? A dilemma arises for some supporters of DTV—in this paper, I focus on Julia Maskivker’s work—because either answer is problematic. First, I argue that it (...) is implausible that DTV applies to _all_ elections because this makes the duty too costly for the voter. Second, I argue that there are no good reasons why under normal circumstances DTV applies only to _some_ elections. I consider objections but conclude that the dilemma is successful and therefore the case for DTV is incomplete. (shrink)

Some Molinists claim that a perfectly good God would actualize a world that is salvifically optimal, that is, a world in which the balance between the saved and damned is optimal and cannot be improved upon without undesirable consequences. I argue that given some plausible principles of rationality, alongside the assumptions Molinists already accept, God’s perfect rationality necessarily would lead him to actualize a salvifically optimal world; I call this position “Optimistic Molinism.” I then consider objections and offer replies, concluding (...) that Optimistic Molinism is undefeated and merits further exploration. This paper deals with the mutations in Wittgenstein’s treatment of the notions of “generality” and of “singularity”, from his first philosophy, in the Tractatus Logico-Philosophicus, to his later mature philosophy represented by the Philosophical Investigations. As we shall see, Wittgenstein’s philosophical handling of the notion of “visual perception” plays a key role in those conceptual transformations.

In the discourse on International Justice, traditional frameworks are deeply rooted in 'embodied metaphysics'—a perspective embedded in the tangible experiences of human existence. By contrasting the physical with the digital realms, I suggest that our current global justice systems are ill-equipped to address the complexities of the digital age. Utilizing the metaphor of water to highlight the often-unseen environment shaping justice theories and practices, I argue that International Justice, as conventionally understood, reflects the constraints akin to fish oblivious to the (...) water surrounding them. In digital spaces, individuals are no longer bound by principles of singularity and locality, and instead operate by principles of multiplicity and nonlocality. These metaphysical differences disrupt many theories of global justice assuming singularity and nonlocality. My aim is to encourage scholars and practitioners to 'see water'—to acknowledge and critically reassess the foundational assumptions underlying their theories and practices in an era of digital transformation. The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias. Testimony about the future dangerousness of a person has become a central staple of many judicial processes. In settings such as bail, sentencing, and parole decisions, in rulings about the civil confinement of the mentally ill, and in custody decisions in a context of domestic violence, the assessment of a person’s propensity towards physical or sexual violence is regarded as a deciding factor. These assessments can be based on two forms of expert testimony: actuarial or clinical. The purpose of this (...) paper is to examine the scientific and epistemological basis of both methods of prediction or risk assessment. My analysis will reveal that this kind of expert testimony is scientifically baseless. The problems I will discuss will generate a dilemma for factfinders: on the one hand, given the weak predictive abilities of the branches of science involved, they should not admit expert clinical or actuarial testimony as evidence; on the other hand, there is a very strong tradition and a vast jurisprudence that supports the continued use of this kind of expert testimony. It is a clear case of the not so uncommon conflict between science and legal tradition. (shrink)

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

Para comprender se requiere reconocer lo otro en su carácter de tú, asumir que no se tiene distancia frente a él y estar abierto a acoger lo dicho por él como una posible verdad. La compresión posee una estructura dialéctica que implica la cancelación de las propias expectativas y el acceso a un saber más abarcante. Aunque (...) la comprensión es histórica, en ella se muestra cada vez un aspecto de la cosa misma, que resulta de la interacción del yo y el tú en el curso de la conversación hermenéutica y que constituye una verdad común con caracteres análogos a los del saber de tipo práctico. [The paper exposes the role of the other in Gadamer’s hermeneutics in the light of the idea of dialogue. Understanding requires the recognition of the other as a thou, the acceptance of the lack of distance from him and the openness to embrace what is said by him as a possible truth. Understanding has a dialectical structure which implies the cancellation of one’s own expectations and the access to a more comprehensive knowledge. Even though every understanding is historical, it discloses an aspect of the thing itself, which results from the interaction of the I and the thou during the process of hermeneutical conversation and constitutes a common truth with analogous characteristics to practical reason.] . The following is an interpretation of Aquinas’ agent intellect focusing on Summa Theologiae I, qq. 75-89, and proposing that the agent intellect is a metaphysical rather than a formal a priori of human understanding. A formal a priori is responsible for the intelligibility as content of the object of human understanding and is related to Kant’s epistemological views; whereas a metaphysical a priori is responsible for intelligibility as mode of being of this same object. We can find in Aquinas’ text (...) many indications that the agent intellect is not productive of the universal as content but is, rather, productive of the abstracted or intelligible mode of being of the universal nature. This is because for Aquinas the universal nature, which is the object of human understanding, is present in the things themselves but with a different mode of being. Chapter 1 is intended to establish the fact which requires for Aquinas an agent intellect, and provides two very important principles: one is that the object of human understanding (the universal nature) is present in the things themselves and, the other, that it is not in the things themselves with a mode of being which makes it available to the intellectual eye. These two principles lead us to the main point of Chapter 2, namely the distinction between the intelligible object and its intelligible mode of being. Now, because knowing is receptive of the intelligible object (Chapter 3), which is present in the things themselves (Chapter 1), the agent intellect is productive not of the object’s intelligible content, but of its abstracted or intelligible mode of being (Chapter 4). The objective of this article is to try to elucidate Wittgenstein’s ex-travagant thesis that each and every mathematical advancement involves some “semantical mutation”, i.e., some alteration of the very meanings of the terms involved. To do that we will argue in favor of the idea of a “modal incompati-bility” between the concepts involved, as they were prior to the advancement, and what they become after the new result was obtained. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

El uso de sistemas de machine learning en los procesos de selección laboral ha sido de gran utilidad para agilizarlos y volverlos más eficientes, pero al mismo tiempo ha generado problemas en términos de equidad, confiabilidad y transparencia. En este artículo comenzamos explicando los diferentes usos de la Inteligencia Artificial en los procesos de selección laboral en Estados Unidos. Presentamos los sesgos sexuales y raciales que han sido detectados en algunos de ellos y explicamos los obstáculos jurídicos y prácticos para (...) su detección y análisis. Un posible remedio jurídico a la discriminación algorítmica es el régimen de impacto diferencial sistémico utilizado en Estados Unidos. Usamos algunas características de este régimen para señalar los vacíos jurídicos frente a la discriminación en el acceso al empleo en el ámbito del derecho laboral colombiano, y ofrecemos algunas características generales que podría tener un régimen de esa naturaleza. Durante los últimos años, el problema de cómo justificar aquellas creencias que se originan en testimonios ha ocupado un lugar central en la epistemología. Sin embargo, muy pocas de esas reflexiones son conocidas en el derecho probatorio. En el presente ensayo analizo la prueba testimonial a la luz de estas reflexiones con el fin de poner de manifiesto los supuestos epistemológicos de algunos principios procesales. En concreto, analizo la legislación colombiana y la estadounidense en el marco de la disputa entre (...) el reduccionismo y el antirreduccionismo en la filosofía del testimonio. Al final sugiero una nueva aproximación epistemológica que replantea los términos de la disputa y que tiene implicaciones importantes para la valoración de la prueba testimonial en los procesos judiciales.
